Rockville Town Council Meeting Minutes August 17, 2020

August 17, 2020

PRESENT: Mayor Council: Riley Bradham, Frank Thornhill, Zach Nelson, Henry Holst, Allen Holmes and Town Clerk Colleen Key

ABSENT:  none

Meeting called to order at 7:05 with pledge.

Other Present: None / no one requested time on the agenda.

Second Budget Reading: Ordinance Number 6152020 – 2019-2020 for the Record, Read by Mayor Riley Bradham

Income $44,169.81

Expenditures $44,114.08

Zach Nelson motions to adopt the 2019-2020 Budget as read. Seconded by Mayor Riley Bradham. Unanimously approved. Town Council all signed.

Mayor motions to accept prior meetings Minutes as drafted.  Seconded by Zach Nelson.  Unanimously approved.

OLD BUSINESS:

Container Ordinance.  Planning has met and returned with a question and recommendations.  Question: Does the County have a Container Ordinance? The County does, but it does not pertain to Rockville.  Planning recommends existing containers on residential properties be “Grandfathered”. If Grandfathered structures are removed, they may not be replaced.  Question also raised, if existing containers are destroyed can they be replaced with a like structure? Note exact Container specs/number needed.  Mayor to discuss with Town Attorney and brush up the language to include recommendations. Also, will address contractors’ containers. Mayor motions to move forward with Town Attorney and to propose to Council at next meeting.  Frank Thornhill seconded.  All are in favor.

Road cones are gone again. Allen Holmes to get more and a tar to hold them down.

Road signs are being made. Should the Town also have a sign to warn of speed bump? Council suggest a sign within Town boundaries.  Henry Holst to follow up.

Condemnation of Adams House.  Town needs to enact an Ordinance.  Joel Evans from the County to come inspect and make a recommendation about the Adams and the fact that it is on the Historical Register.  The Town needs a specific plan for this instance, and for the future.  Such a plan would have the Town “NOTICE” the property owner with set criteria.  A property owner could fix, sell or do nothing. Mayor to discuss with Town attorney to come up with a Condemnation Ordinance that would protect the Town but also strongly encourage action by a homeowner who has let their house reach a dangerous state of disrepair.

COUNTY HAS APPORTIONED A BUDGET OF $460,000.00 TO FIX ROCKLAND!!! $65,000 now for the study/drafting a plan to begin in the next few weeks.  Balance to be granted in 2021. DHC to continue to maintain SIYC Rd.

New Business:

County has contacted the Mayor about Short Term Rentals. Bolt issues has caused a push in firming up regulations.  The Town currently does not have a Short Term Rental Policy.  County Law does not affect Rockville. Currently there are three well-run rentals and the Town will work with these existing scenarios. The goal with regards for Short Term Rentals Rules in Rockville, would be to disenfranchise any potential developer. County would like Rockville to enact a plan, basically so it is not a County issue. The Town to define Short Term Rentals.  Mainly hope to prohibit any commercial entities and allow homeowner only rentals. Limited traffic resources/ road wear and tear are a major consideration.

Tree Removal. For clarification, emergency tree removal does not require a permit, that is if it has potential for immediate harm.  A potentially dangerous tree does require a permit from the county and is a lengthy process.  Pruning is defined in UDO.  Pine trees are an exception. All Oak species are considered Grand Trees.  Water Oaks are taken on a case by case basis. Process to remove one include a written letter from an Arborist presented to the County and applying for a permit, or appeal to Rockville BZA. Please see page 31 of the UDO for more information.

Council has discussed an increase in salary for Town Clerk. Mayor motions to award an additonal $100 per month. Frank Thornhill seconds.
