- WILPC: Henry Holst – Point Farm lawsuit still pending. Of note – 35 calls were made to Wadmalaw Island Fire Department in March.
Old Business:
Regarding Marina Road landscaping company commercial activity, the issue has been resolved per John Hope. Most commercial vehicles/equipment have been moved. Tammy Bazzle mentions one neighbor has complained when the homeowner landscaped his own yard that the there were vehicles on both sides of the road but pointed out that as soon as they were finished everyone left.

CDH will be working on SIYC road. Excessive rain has caused deterioration. Grace Chapel has 3 big holes which will also be addressed.
Commercial Noise Ordinance draft has been completed. The need has arisen by the brigade of landscapers lately. Will not impact a homeowner’s ability to make noise, only commercial noise and will be modeled after Charleston City and County Ordinances. The intent is to maintain the aesthetic atmosphere and quiet enjoyment of the land. This first draft allows for a time frame for commercial activity of 9-5 Monday through Friday and in summer months (June July August) 8-4. On Saturday the hours may be 9-3. No commercial noise on Sunday. Commercial noise will be defined. Frank Thornhill questions would aspects of party set up like a tent or bar be affected? Mayor comments that this law aims to curtail things like nail guns, saws, weed eaters, blowers, roofing, etc. The Town’s goal is to be reasonable. Frank Thornhill asks has there ever been a case where when someone was confronted, be it a contractor or neighbor, regarding excessive noise has it not been handled diplomatically and point out that this rule may be a slippery slope? Tammy Bazzle and Mayor detail that there have been complaints which is causing the necessity for parameters, particularly egregious noise. Town may need to have some teeth and claws for regulating this issue? Tammy Bazzle mentions that a property owner may know how to operate “commercial type” equipment which can result in the same sort of noise. Mayor proposes that a course of action where an egregious actor could be identified, and council could follow up rather than an ordinance at this point. Whit Smith comments that maybe this could be handled at DRB level when plans are being reviewed for approval? Potentially a contractor’s packet could detail town policy. Council needs to ponder does the Town need another law? Mayor suggests that look at how other small towns handle the issue. The Town needs the ability to answer a resident when they have a complaint.
New Business:
Yacht club members, the Hoys, are having a wedding in June, they plan to use small vans, under 32 feet which are permissible. Same company that has been approved before. Town Council notes that these are acceptable.
Henry Holst mentions that the white line on the road from the store to Preston Wilson house has disappeared by 8 inches.
Whit Smith was approached by his neighbor Chip Linton regarding a tree on Linton property that might fall at any time and wondered whose financially responsible for its removal. Mayor comments that when a tree is located on private property it is the sole responsibility of the property owner and that the property owner can remove the tree if permitted to do so. The Town will help in removal of trees on Town property in known Right of Ways. Pages 30 – 33 of UDO specifically address tree removal permitting and the Town is always willing to help any resident in their endeavors to achieve a permit.
